Wesfarmers – South Australia Workers Compensation

For South Australian Team Members Only

You have chosen to participate in the InjuryCARE early intervention program. Which entitles you to:

  • Up to 4 MAX Health doctor visits
  • Up to 4 MAX Health physiotherapy visits (when referred by a MAX Health doctor)
  • An x-ray and / or basic ultrasound for diagnosis
  • Reasonable simple ancillary medical costs i.e. simple medications and bandages
You always have the right to choose your own treating practitioner and submit a workers compensation claim. 

Your rights, entitlements and obligations under a claim are as follows. 
 
Your Rights
  • To lodge a workers’ compensation claim at any time.
  • To choose your own treating practitioner.
  • To be provided with copies of recovery and return to work plans and medical reports.
  • To have information about your injury kept confidential.
  • To be supported by another person or represented by a union, advocate or lawyer, or an interpreter if required.
  • To be consulted regarding your rehabilitation and return to work (RRTW) plan.
 
Making a claim for Workers’ Compensation?

Workers compensation insurance provides support (medical expenses and income) for workers with a work-related
injury.

Wesfarmers are self-insured for workers compensation and Wesfarmers Group TeamCover (GTC) are the insurer.

Should you choose to make a claim for workers’ compensation, you must:

  • Obtain a workers’ compensation medical certificate from a medical practitioner that states your work-related injury/ illness.
  • Complete a claim form which you can obtain from your line manager, Health and Wellbeing Team, or here –

  • Provide your completed claim form and medical certificate to your line manager who will lodge it with GTC.

GTC will then:

  • Contact you on receipt of your claim.
  • Aim to determine liability for your claim within 10 business days and provide you with an explanation for the decision in
    writing.
 
Your Entitlements:
  • If your claim takes longer than 10 business days to determine, GTC are required to offer you interim payments to cover your
    income and medical expenses pending the final determination of your claim.
  • If your claim is rejected, you are entitled to request GTC or the SA Employment Tribunal (SAET) to review the decision (SAET
    https://www.saet.sa.gov.au/).
  • Once your injury has stabilised you may be assessed to have a level of whole person impairment where it may entitle you to
    a lump sum payment. If you are assessed as seriously injured you may be entitled to additional entitlements.
 
Your Responsibilities & Obligations:
  • To actively participate in recovery and return work activities, and return to suitable employment when able to do so.
  • Provide ongoing workers’ compensation medical certificates whilst you remain unable to perform your pre-injury role.
 
Return to Work:
  • If your injury prevents you from returning to your pre-injury duties your employer (RTW Coordinator, Injury Management
    Advisor, Line Manager), GTC and your doctor in consultation with you will modify your duties/hours or identify suitable
    alternative duties in your workplace and prepare a recovery and return to work plan to support this.
  • You can request RTWSA or SAET to review the provision of any recovery and return to work service or provision of suitable
    employment under the Act.
 
Complaints:
  • If you have a complaint, in the first instance you should raise your issue directly with your employer. If you are not satisfied,
    you are entitled to contact RTWSA via complaints@rtwsa.com
    , lodge RTWSA’s online complaint form or refer the matter to
    the State Ombudsman https://www.ombudsman.sa.gov.au/.
 
Your Employer
  • Has the right to expect you to comply with the actions and obligations under your RRTW plan.
  • Is required to support you in your recovery and return to work and provide suitable employment if you cannot return to
    your pre-injury role.
